Sessions at the Presidio Website Privacy Policy

We value your privacy, and we want to help make your experience with Sessions at the Presidio ("Sessions", "we" or "us") and our website available at www.sessionssf.com (the "Sessions Website") as satisfying and safe as possible. We have established this Privacy Policy to explain how we collect Personal Identifiable Information (“PII”) (as defined below) on the Sessions Website, and how we use and disclose PII. This Privacy Policy also applies to PII that we collect by other means, such as "offline" from guests of Sessions, which we combine with PII collected on the Sessions Website. Any capitalized terms not defined herein have the meaning set forth in the Sessions Terms of Use. Personally Identifiable Information

 

"Personally Identifiable Information" (or "PII") refers to contact information that directly or indirectly tells specifically who you are, such as your name, phone number, company name, job, email, postal address, or any other information that could be linked to you with reasonable effort. We do not collect sensitive information such as location information (GPS), racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, biometric data, data concerning health, or data concerning a natural person's sex life or sexual orientation. 

 

1. How the Sessions Website Operates

In our operation of the Sessions Website, and our provision of services to you and other users, we collect, use, and retain all information, including PII, that you disclose to us. Our use and disclosure of PII is described in this Privacy Policy. Our disclosures of PII to our partners and affiliates are described in greater detail under the "When We Disclose Personal Identifiable Information" heading below. In general, the types and amount of personally identifiable information we collect vary depending on the activity. We endeavor to limit the collection of personally identifiable information to information we believe is minimally necessary to achieve our stated collection purposes.

2. Information We Collect

We collect two types of data about users: (1) information that you or others voluntarily submit to us (described below under "User Supplied Information") and (2) technical data automatically collected from all visitors to the Sessions Website (described below under "Passive Data Collection").

3. User Supplied Information

You may provide us with your email address in order to receive communications from us. If you choose to provide information to us, you are giving us permission to use and store that information consistent with this Privacy Policy.

4. Passive Data Collection

Like most web-based services, we automatically receive and record information on our server logs from your browser when you use the Sessions Website. We may use a variety of methods, including clear GIFs (also known as "web beacons") and "cookies", to collect this information. The information that we collect with these automated methods may include, for example, your IP address, cookie information, a unique device or user ID, browser type, system type, the content and pages that you access on the Sessions Website, and the "referring URL" (i.e., the page from which you navigated to the Sessions Website).

We also use cookies on the Sessions Website to store session validators on your hard drive.  We may use passively collected data to: (a) remember your information so that you will not have to re-enter it during your visit or the next time you visit the Sessions Website; (b) monitor your participation in various sections of the Sessions Website; (c) customize our service to you, including by providing you with recommendations; (c) monitor aggregate site usage metrics such as total number of visitors and pages viewed; and (d) administer, operate, and improve the Sessions Website and our other services and systems, and to provide services and content that are tailored to you. If we directly combine any information gathered through passive means with PII, we treat the combined information as PII under this Privacy Policy. Otherwise, we use information collected by passive means in aggregated forms.

The information these cookies collect cannot track your activity on non Sessions websites.  You can choose to disable cookies entirely in your internet browser, but this may decrease the quality of your user experience. 

5. How We Use Personal Identifiable Information

We use PII to establish and enhance our relationship with you. We may use PII to operate, provide, improve, and maintain the Sessions Website, and to develop new products and services; to prevent abusive and fraudulent use of the Sessions Website; to personalize and display content on the Sessions Website; to send you information about other events or services in which we believe you may be interested; and for other administrative and internal business purposes.

We may use your e-mail address for administrative communications such as communicating with you, notifying you of major Sessions Website updates, for customer service purposes, and to send privacy or security-related notices.

6. When We Disclose Personal Identifiable Information

We do not rent or sell email addresses and other PII. We do not share PII with third parties except in the limited circumstances described in this Privacy Policy.

Sessions Service Providers

We may provide PII to third parties for their use in performing internal business functions (e.g., payment processing, maintenance, security, data analysis, email transmission, or data hosting) on our behalf. Such entities only use your PII in accordance with this Privacy Policy and for no other purpose than to provide us with necessary services. Additionally, we use Google Analytics to analyze our users’ use of the Sessions Website. Google Analytics provides us with aggregated data in order to help us make informed business decisions. We have indicated to Google that information collected through our use of Google Analytics on the Sessions Website should not be shared with third parties, even in an anonymous, aggregated fashion. Ultimately, Google, as a third party, controls information collected through Google Analytics, and you should check and be comfortable with their privacy practices at https://policies.google.com/privacy prior to using the Sessions Website.

Sessions Affiliates

We may share some or all of your PII with our affiliates (including a parent company, subsidiaries, joint venture partners or other companies that we control or that are under common control with us), in which case we require those affiliates to honor this Privacy Policy.

Legal Requirements

We may disclose PII if we have a good-faith belief that doing so is required by a subpoena or other judicial or administrative order or otherwise required by law or court of competent jurisdiction. Additionally, we may disclose PII where we, in good faith, deem it appropriate or necessary to prevent violation of the Sessions Terms of Use, or our other agreements; take precautions against liability; protect the rights, property, or safety of Sessions, any individual, or the general public; maintain and protect the security and integrity of our services or infrastructure; protect ourselves and our services from fraudulent, abusive, or unlawful uses; investigate and defend ourselves against third-party claims or allegations; or assist government enforcement agencies.

7. Change of Ownership

In the event of a change in ownership, or a merger with, acquisition by, or sale of assets to, another entity, we reserve the right to transfer all of your PII, including email addresses, to that entity. We will use reasonable efforts to notify users of such a transfer (by a posting on our homepage, or by email to your email address that you provided to us, as chosen by us in our discretion).

8. Security

We use industry standard security measures to protect against the loss, misuse, and alteration of PII under our control. Although we make good faith efforts to maintain the security of such PII. As no method of transmission over the internet in completely secure we cannot guarantee the absolute security that users PII  will remain free from unauthorized access, use, disclosure, or alteration. Further, while we work hard to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent "hackers" or other unauthorized persons from illegally accessing or obtaining this information.

If we learn of a security breach, we may attempt to notify you electronically so that you can take appropriate protective steps. By using the Sessions Website or providing PII to us, you agree that we can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Sessions Website. If a security systems breach occurs, we may post a notice on our homepage (www.sessionssf.com), or elsewhere on the Sessions Website and may send email to you at the email address you have provided to us. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

9. Your Choices

You may, at any time, update, correct, or delete certain PII that you have provided to us by contacting us at info@sessionssf.com or at the address set forth below in the "Contacting Us" Section below.

Please be aware that even if you update or remove PII that you have provided to us, your PII may be retained in our backup files and archives for a reasonable period of time for legal purposes.  We will not retain your PII for longer than required.

11. Third-Party Services

The Sessions Website may contain links to websites and information regarding services provided by third parties. Any PII you provide to third parties via use of third-party sites, or use of third party services is provided directly to that third party and is subject to that third party's policies governing privacy and security. We are not responsible or liable for the content or privacy and security practices and policies of third-party sites or services. We encourage you to learn about third parties' privacy and security policies before providing them with PII.

12. International Users

The Sessions Website is hosted in the United States. If you use the Sessions Website from the European Union, or any other region with laws governing data collection and use that may differ from United States law, please note that you are transferring your personal data outside of those jurisdictions to the United States. The United States does not have the same data protection laws as the European Union and other regions. By providing PII under this Privacy Policy, you consent to the use of PII in accordance with this Privacy Policy and the transfer of your PII to the United States.

The Sessions Website complies with the EU-U.S. Privacy Shield Framework, the General Data Protection Regulation, and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and the United Kingdom and/or Switzerland to the United States.

​13. Changes and Updates to This Privacy Policy

This Privacy Policy may be updated or amended from time to time in order to maintain compliance with current law and to reflect any changes to our data collection process. If we do, we will update the "Effective Date" at the top of this Privacy Policy. We recommend that you periodically review this Privacy Policy to stay informed about our collection, use, and disclosure of PII on the Sessions Website. Your continued use of the Sessions Website constitutes your agreement to this Privacy Policy and any updates. 

14. Your California Privacy Rights

This section provides additional details about the PII we collect about California consumers and the rights afforded to them under the California Consumer Privacy Act or “CCPA” and California Law SB 27.  Under California Law SB 27, California residents have the right to receive, once every 12 months.

Subject to certain limitations, the CCPA provides California consumers the right to request to know more details about the categories or specific pieces of PII we collect (including how we use and disclose this information), to delete their PII, to opt out of any “sales” that may be occurring, and to not be discriminated against for exercising these rights.  For more details about the PII we have collected over the last 12 months, including the categories of sources, please see the How We Collect and Use Your Data sections above.

California consumers may make a request pursuant to their rights under the CCPA or California Law SB 27. To make such a request, please send an email to info@sessionssf.com and include the phrase "California Privacy Request" in the subject line, the domain name of the Web site you are inquiring about, along with your name, address and email address. We will respond to you within thirty days of receiving such a request. We will verify your request using the information associated with your account, including email address. Consumers can also designate an authorized agent to exercise these rights on their behalf.
